Fit Dragon’s general counsel confirms Commando Dave’s claims of "Code of Ethics violation" by Nautilus, Inc.

Seattle, WA: January 19, 2010

A few days before launching his virtual reality show, "GOIN’ ALL IN!" Commando Dave received an unexpected gift wrapped in a magazine article by Editor-in-Chief, Therese Iknoian on SNEWSnet.com [Search: Commando Dave].

"The quotes by Reed Brown, Fit Dragon’s general counsel, pretty much sum up my claims of patent infringement, misrepresentation and unfair business practices which violate Nautilus, Inc's Code of Ethics," states Commando Dave.

In the December 30, 2009 article entitled, "Did you hear?...Commando Dave tracking new StairMaster owner to seek patent payout," Therese Ikonia writes:

"According to C. Reed Brown, general counsel for Land America, which is the company behind Fit Dragon, Commando Dave’s claim was not in the disclosure papers by Nautilus, indicating to him that Nautilus was not aware of the claims. In addition, he explained that design patents aren’t worth much. Everybody uses reading racks,” he said. “It’s as if I claimed I had a patent for four wheels on a car. "

Commando Dave responds with, "Nautilus has been fully aware of this matter since my March 2005 introduction to the company's IP attorney Lee Osman of the firm Dorsey & Whitney in Denver; 22 months of eMails exchange on my website confirms that."

The producer of Commando Dave's Show added, "Prior to the close of the deal between Nautilus and Fit Dragon, I put all 13 advisors of Robert W. Baird & Co. and Nautilus, Inc director, Ronald P. Baide on notice. Just because they haven't taken it as serious as it is, doesn't diminish the claims that have been made since 1998."

Commando injected, "Along with those claims, I've notified Dorsey & Whitney numerous times that Nautilus, Inc. is in violation of its Code of Ethics, Item 8, Fair Dealing by blocking my fair right of representation by the same IP firm I retained to secure my patent. So it's easy for Mr. Brown to say 'design patents aren't worth much' when Nautilus is barring my access to the firm responsible for my patent's value."

Dave elaborated with, "In short, StairMaster and I were represented by the same IP firm Seed & Berry, 10 years ago. Since that time, Seed & Berry became the "spin-off” firm Seed IP which still has my patent file in its same, Fifth Avenue, Columbia Center, file cabinets. Seed IP does not represents the StairMaster brand, nor Nautilus, Inc., yet a conflict of interest still exists. And Nautilus, Inc.'s refusal to sign a waiver in 2007, violates its Code of Ethics in my estimation."

Commando Dave went on to say, "Mr. Brown is absolutely right about, 'everyone uses reading racks,' thanks to my product. And his 'four wheels on a car' analogy is excellent, since my product became an industry standard. And that evolution began when StairMaster knocked off my product which led to designing my product into their machines. The industry followed suit."

"So Mr. Brown not only confirmed my claims, it also appears that he may have leaked Nautilus, Inc's. improper disclosure concerning the StairMaster deal," Commando Dave pointed out.

Commando wrapped things up by mentioning that he calls GOIN’ ALL IN! a "business documentary/virtual reality show" because all of his claims are backed up with real documentation in the virtual world of his website, blog, YouTube, Twitter, Facebook and now the website of SNEWS, the most trusted outdoor and fitness industry news source since 1984.

"It’s like I say, 'Reality shows are scripted. Commando Dave's Show is virtually scripting itself,'" Commando Dave ended with.
